Jacobs Fitness, Inc. — Terms of Service

1. Acceptance of Terms:
By purchasing any service, digital product, or coaching program offered by Jacobs Fitness, Inc. ("Company," "we," or "us"), you ("Client" or "you") agree to be bound by the following Terms of Service. Please read these terms carefully. If you do not agree, do not purchase or use our services.
2. Scope of Services:
• Jacobs Fitness provides coaching services including, but not limited to:
• Functional movement assessment
• Strength and mobility training
• Nutrition and habit coaching
• Education on breathing, posture, recovery, and performance
Services may be delivered through:
• In-person private sessions
• Online personalized training programs
• Zoom/phone consultations
• Messaging apps and client portal
Jacobs Fitness does NOT provide:
• Medical advice, diagnostics, or treatment
• Physical therapy or rehabilitation
• Psychological therapy or counseling
• Meal plans created by a registered dietitian
All services are educational and consultative in nature.
3. 1:1 Coaching: Nutrition and Training Check-Ins:
Clients participating in 1:1 coaching are expected to:
• Submit check-ins weekly on the agreed-upon day by 11:59 PM EST.
• Include completed check-in documents, food logs (e.g., MyFitnessPal), and any relevant training updates.
• Share training videos weekly for feedback on form and performance.
• Attend check in calls when deemed appropriate by coach and scheduled at their convenience (based on coach availability).
Failure to complete check-ins may delay program updates, communication, and progress. Ongoing missed or incomplete check-ins may result in paused or terminated coaching at our discretion.
4. General Communication:
Designated Communication Channels:
• WhatsApp (preferred), email, and SMS.
• Coaching-related messages sent via social media will not be addressed.
Response Times:
• Business Days/Hours: Monday -Thursday 8 am- 8pm, Friday 8am- 6pm
• Training video feedback: within 48 business hours.
• General messages and emails: within 24 business hours.
• Lab work reviews: within 72 business hours.
Coaches may reach out after a missed check-in; however, it is the client’s responsibility to initiate regular communication.
5. Testing and Lab Work Communication:
Clients utilizing lab work and functional testing services (e.g., blood panels, hormone analysis, GI mapping) will receive review feedback within 72 business hours.
Reviews may be provided as:
• Written notes in Email
• Audio Recordings
• Video recordings
• Optional phone or zoom calls (if additional context is needed)
All results are reviewed from a coaching and educational perspective only. Jacobs Fitness does not diagnose or treat any medical conditions.
6. Minimum Commitment, Cancellations, Payments, and Refunds:
Minimum Commitment:
• A 3-month minimum is required for all coaching programs.
Subscription Billing:
• Services are billed automatically in 1-, 3-, or 6-month intervals, as selected.
• Billing occurs every 4 weeks on Monday
Cancellations:
• Clients must submit written notice (email or text) at least 30 days prior to their next billing cycle.
• Cancellations made after the billing date will apply to the following cycle.
Pausing Services:
• One (1) 30-day pause is permitted annually after the initial 3-month term.
• Pauses must be requested and approved in writing. Additional pauses are not guaranteed.
Refunds:
• All sales are final. There are no refunds once a payment has been processed.
• Early termination prior to the minimum term does not release the client from remaining financial obligations.
7. Client Responsibilities:
Clients agree to:
• Submit weekly check-ins and required logs consistently.
• Communicate about planned absences or schedule conflicts.
• Follow programming to the best of their ability.
• Ask questions if confused or experiencing difficulty.
Failure to engage or submit required materials may result in lack of progress and reduced coach interaction.
8. In-Person Training Sessions:
• Sessions must be scheduled through the Jacobs Fitness app.
• Active training package is required to book.
• Session expire in 1 month (single), 3 months (10 pack), and 6 months (20 pack).
• Sessions canceled within 24 hours will be charged in full.
• Sessions last 60–90 minutes depending on the program.
• Default sessions are 1:1. Adding a second participant requires advance approval and incurs a 1.5x rate.
9. Vacation & Holidays:
Coach Availability:
• 1 week per quarter: slower communication (up to 48 hours), no lab or training video reviews.
• 2 full weeks annually: no communication or feedback; 2 weeks will be added to the client’s program term.
Holidays Observed:
• New Year’s Day
• Memorial Day
• Independence Day
• Labor Day
• Thanksgiving (Thu/Fri)
• Christmas Eve and Day
Check-in procedures will be adjusted around holidays. Updates will be communicated in advance.
10. Assumption of Risk:
By enrolling in any Jacobs Fitness service, the client affirms:
• They are medically cleared to participate in physical activity.
• They understand and accept the inherent risks associated with exercise and health coaching.
• They release Jacobs Fitness and all affiliated parties from liability in the event of injury, illness, or loss.
Clients are responsible for notifying the coach of any injuries, health conditions, or contraindications before starting or continuing programming.
11. Intellectual Property:
All content shared by Jacobs Fitness is proprietary and protected.
Clients may not:
• Reproduce, distribute, or modify any program or material
• Record or resell any instructional content
• Share login credentials or documents with non-clients
All rights to course names, frameworks, systems, and videos are reserved.
12. Privacy Policy:
• We take your privacy seriously. All information shared during your coaching relationship is kept strictly confidential. Your data will never be sold or shared without written permission.
• Progress photos, testimonials, or case studies may be shared anonymously on our platforms. If you do not wish for any client content to be shared, please inform your coach in writing.
13. Disclaimer:
• Jacobs Fitness, Inc. provides services for general health education and fitness enhancement. We do not diagnose, cure, or treat medical or psychological conditions.
• No content or communication from Jacobs Fitness should be interpreted as a substitute for professional medical advice or care. Always consult with a licensed healthcare provider before beginning any new exercise or nutrition program.
14. Termination of Coaching:
We reserve the right to terminate services at any time due to:
• Repeated missed check-ins or lack of participation
• Non-payment or unresolved billing issues
• Abusive, disrespectful, or threatening behavior
• Breach of any terms outlined in this agreement
If terminated, the client is responsible for any unpaid balance.
15. Agreement:
By purchasing, enrolling, or submitting payment to Jacobs Fitness, Inc., you agree to these Terms of Service.
